Terms and Conditions

These Terms & Conditions govern the submission of requests through cmmcalibrationdetroit.com, the issue of quotations in response to them, and the performance of CMM Calibration and related work arranged through this site. Submitting a request, or accepting a quotation issued in response to one, is taken as acceptance of these terms. Where a signed supply agreement or agreed purchase-order terms are already in place, that agreement takes precedence over these terms to the extent of any conflict.

Review comes before quotation, on every request. What it confirms is that the requirement is stated clearly and understood, that the method, range and measurement capability needed are available, and that the laboratory selected to carry out the work is competent to perform it.

Where a statement of conformity is required, two things are settled in writing before work begins: the decision rule to be applied, and the specification the item is to be assessed against. Where a requirement changes after acceptance, the review is repeated and the change confirmed to the customer before work continues. Where a request cannot be met as specified it is declined, or returned with an alternative scope, and it is never accepted and quietly reduced.

Every quotation goes out in writing. Validity is thirty (30) days from the date of issue, unless the quotation names a different period. The figures in it come from the item description, quantity, measurement points, tolerances and turnaround supplied with the request.

Where the item received is not the item described — extra channels, a wider range, damage, or a condition needing repair before measurement is possible — work is held while a revised quotation is issued. Nothing proceeds until that revision has been approved in writing.

Turnaround is quoted in business days and runs from receipt of the item or receipt of written approval to proceed, whichever is later. Expedited handling is available where capacity allows and is quoted separately. Turnaround commitments are given in good faith against current capacity. Where one cannot be met, notice is given as soon as the delay is known — with a revised date.

Protective packaging adequate for transit is required, as are any accessories, fixtures, cables or software needed to complete the work. Risk in transit, in both directions, rests with the customer — unless carriage has been arranged and charged on the quotation.

Any item found to be unsafe, contaminated, or outside the condition accepted at review is returned unworked with the reason stated. After the collection or despatch period agreed on the quotation, completed items are held at the customer's risk.

Payment is due in full before certificates and items are released, unless a credit account has been approved in advance. Where it has, invoices are payable net thirty (30) days from the date of invoice.

Unless the quotation states otherwise, prices exclude taxes, duties and carriage. Interest may be charged on overdue balances at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law, and further work may be suspended while an account is overdue.

The laboratory that performed the work issues the certificate or report, and it remains that laboratory's technical record. Payment in full gives the customer an unrestricted right to keep, copy and use the certificate for its own quality, audit and regulatory purposes.

Certificates are complete documents, and reproduction is in full or not at all — partial reproduction requires written approval. The performing laboratory retains copies for the period stated in its records policy, and a reissue is made against the original certificate number.

Everything obtained or created in the course of a request is confidential — drawings, specifications, tolerances, measurement results, and the existence of the engagement itself. Access is limited to the personnel and providers who need it to complete the work. Two exceptions are stated: disclosure required by law, and disclosure to an accreditation body exercising its rights of access. Where the law requires disclosure, the customer is notified unless that notification is itself prohibited.

The standard of performance is reasonable skill and care, in accordance with the methods and standards stated on the quotation and on the resulting certificate. Defective work is remedied by re-performance of the affected work or by a refund of the amount paid for it, whichever the customer elects.

Liability is capped. To the maximum extent permitted by law, total liability arising out of any engagement is limited to the amount paid for the work giving rise to the claim, and loss of profit, loss of production, loss of contract and any indirect or consequential loss are excluded. Nothing here limits liability that cannot be limited by law.

These terms are governed by the laws of Michigan and conflict-of-law principles are not applied to them. Unless a different forum has been agreed in writing, a claim is brought in the courts of that jurisdiction.
